1. Introduction
These Terms of Service ("Terms") govern the provision of staffing and labour supply services by Gangal Recruitment Ltd ("the Company", "we", "us") to client businesses ("the Client", "you"). By engaging our services, you agree to be bound by these Terms. These Terms form the basis of the contract between the Company and the Client.
2. Services Provided
The Company provides specialist staffing services in two sectors only:
- Commercial Cleaning: Supply of vetted cleaning operatives to hotels, warehouses, offices, large buildings, construction sites and student accommodation across the UK.
- Demolition Labour: Supply of CSCS-carded demolition labourers and site clearance operatives across Yorkshire and the UK. CIS-registered.
The Company does not provide staffing services in any other sector. Any engagement outside of the above services must be agreed in writing by a Director of the Company.
3. Minimum Contract Requirements
- Cleaning contracts: Any number of operatives per engagement. Ongoing or volume contracts preferred.
- Demolition contracts: No minimum project value. Any size strip-out or demolition contract welcome.
- The Company reserves the right to decline engagements below these minimums or that fall outside our specialist areas.
4. Rates and Payment
- Hourly rates are as published on our website or agreed in writing prior to deployment.
- Rates are all-inclusive: worker pay (NLW), Employer National Insurance, holiday pay accrual, DBS checks, sector training, PPE and management.
- Invoices are issued weekly in arrears. Payment terms: 14 days from invoice date.
- Late payment will incur interest at 8% above Bank of England base rate (Late Payment of Commercial Debts Act 1998).
- The Company reserves the right to withdraw workers from site if invoices remain unpaid beyond 21 days.
5. CIS — Construction Industry Scheme
For demolition and site clearance contracts where the Client is a construction main contractor, the Client is responsible for applying CIS deductions in accordance with HMRC regulations. The Company is CIS-registered. The Client must provide a valid UTR number before CIS deductions are applied. CIS deductions do not reduce the agreed gross hourly rate on the Company's invoice.
6. Client Obligations
- The Client must ensure a safe working environment compliant with the Health and Safety at Work Act 1974 and CDM Regulations 2015.
- The Client must provide adequate site induction, PPE (where additional to that supplied by Gangal), and access to welfare facilities.
- The Client must not direct operatives to perform work outside their agreed role or training without prior agreement with the Company.
- The Client must report any issues with operative conduct or performance to the Company's account manager immediately.
7. Replacement Guarantee
If any operative supplied by the Company does not meet the Client's reasonable standards, the Company will provide a free replacement operative within 24-48 hours of notification. This guarantee is subject to the Client providing specific, documented feedback on the operative's performance failure.
8. Temp-to-Perm Transfers
If the Client wishes to directly employ any operative introduced by the Company on a permanent basis, the Client must notify the Company in writing. A transfer fee will be payable, calculated at 15% of the operative's anticipated annual salary. The transfer fee is waived if the operative has been supplied continuously for 14 weeks or more.
9. Liability
- The Company carries £10,000,000 Public Liability insurance and £5,000,000 Employer's Liability insurance.
- The Company's liability to the Client shall not exceed the total fees paid by the Client to the Company in the 3 months preceding the claim.
- The Company is not liable for loss of profits, indirect loss, or consequential loss of any kind.
- The Client remains responsible for supervising operatives on site and ensuring safe systems of work.
10. Termination
Either party may terminate an ongoing staffing arrangement by giving 1 week's written notice. Cancellation of a confirmed booking with less than 24 hours notice will incur a charge equal to 4 hours pay per operative booked.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
